BUYER’S PREMIUM:  A 10% Buyer’s Premium will be added to the winning bid to determine the contract selling price for real estate. TERMS & CLOSING:   Purchaser shall make a $50,000 down payment at the conclusion of the auction of in the form of cash, certified check, cashier’s check, or good personal check secured by purchaser’s personal demand note payable to the RE/MAX 100.  Balance to be paid for a general warranty and insurable title on or before 45 days.  Possession with deed.  In the event BUYER fails to perform according to the terms of this contract, the down payment shall be forfeited as partial liquidated damages, and not as a penalty, without affecting any of SELLER’S further remedies.  Either party may demand specific performance of the agreement.
